Terms and Conditions

Effective Date: May 26, 2025

By accessing or using fromzero.ai (“Website”, “Platform”, “Service”), including any purchases, tile claims, affiliate participation, or content submissions, you agree to the following Terms and Conditions (“Terms”). If you do not agree, you must not use this Website.

1. Acceptance of Terms

By using the Website, you agree to be bound by these Terms, our Privacy Policy, and all applicable laws or regulations. These Terms apply to all visitors, users, and others who access or use the Service.

2. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Website. By using the Platform, you represent and warrant that you meet this requirement.

3. Nature of the Service

fromzero.ai operates a digital advertising and media experiment known as The Favicon Gallery, where users may claim visual ad tiles for display. Each claimed tile includes:

  • A favicon (website icon)
  • A title and description
  • A permanent hyperlink to the user’s website
Definition of “Permanent”:
"Permanent" means the tile will remain visible and accessible for the lifetime of the fromzero.ai website and its core infrastructure. While we strive to ensure long-term availability, no specific uptime guarantee is made, and permanency is limited to the operational life of the Platform.

This project is an experimental public case study in creative entrepreneurship. We make no guarantees about web traffic, SEO performance, revenue, or monetization.

A permanent digital ad tile on fromzero.ai, visible for as long as the platform operates, costing $99.99 per tile. We will make reasonable efforts to preserve purchased tile placements in any legacy or successor version of the project.

4. Tile Claims and Submissions

When you claim a tile:

  • You grant fromzero.ai a non-exclusive, royalty-free, worldwide license to display your favicon, site title, description, and link publicly.
  • You certify that all submitted content is owned by you or used with full legal permission.
  • We reserve the right to remove or reject any tile or content at our sole discretion, especially if it includes hate speech, adult material, malware, spam, copyright infringement, or illegal activity.
  • All tile purchases are final and non-refundable, except as described in our Refund Policy.

5. Intellectual Property

 Unless otherwise noted, content on the Website—excluding user-submitted materials—generally belongs to fromzero.ai or its collaborators. 

5.1 Terms of Service — Favicon Upload & Intellectual Property

  1. User Responsibility
    By submitting a favicon image, you warrant that you:
  • Own all rights, title, and interest in the favicon, or have explicit permission from the rightful owner to use it.
  • Have not uploaded any favicon or logo owned by third parties without authorization.
  • Understand that unauthorized use of third-party images may violate copyright, trademark, or other intellectual property laws.
  1. Prohibited Content
    You agree not to upload:
  • Favicons or logos belonging to brands, companies, or websites you do not own or represent.
  • Images infringing on copyrights, trademarks, or other protected rights.
  • Content that violates any applicable laws or the rights of others.
  1. Enforcement and Removal
  • The Favicon Gallery reserves the right to remove or disable any favicon tile that violates these terms, at our sole discretion, without prior notice.
  • Users are responsible for any legal consequences arising from improper use of third-party images.
  1. Indemnification
    You agree to indemnify and hold harmless The Favicon Gallery and its affiliates from any claims, damages, or legal actions resulting from your favicon upload.

5.2 User-Friendly Upload Guidelines

Upload Your Own Favicon
Please upload a favicon or logo that you own or have permission to use. This helps keep the gallery authentic and protects you from legal issues.

Not Sure About Usage Rights? 

  • If you have a YouTube channel, blog, or business, upload your own branded favicon or logo.
  • Avoid uploading favicons from other websites or brands you don’t own—even if you like them! Unauthorized use can lead to removal.

Why Does This Matter?
Using your own favicon means:

  • Your tile is uniquely yours forever.
  • You avoid copyright or trademark issues.
  • You contribute to a respectful, creative community.

6. Prohibited Uses

You agree not to:

  • Use the Service for unlawful or deceptive purposes
  • Submit malicious content (viruses, spyware, phishing links, adult or violent material)
  • Interfere with site performance or user experience
  • Copy, scrape, or reverse engineer any part of the Platform
  • Abuse, manipulate, or misrepresent your tile content or usage

Violations may result in immediate termination, tile removal, and legal action.

7. Affiliate Participation

Participation in our affiliate program is optional and governed by a separate agreement. We reserve the right to change or end the program at any time, with or without notice.

8. No Warranty – Use at Your Own Risk

The Platform is provided “AS IS” and “AS AVAILABLE.” We do not guarantee that:

  • The service will be uninterrupted or error-free
  • Claimed tiles will produce visibility, revenue, or search ranking benefits
  • Tiles will function indefinitely (due to possible future web technology changes)

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, FROMZERO.AI AND ITS TEAM SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, or consequential damages
  • Any loss of revenue, data, or reputation
  • Any issues arising from content you submit or link to
  • Issues related to third-party platforms or integrations

In all cases, our total liability shall not exceed the amount you paid us in the last 12 months.

10. Third-Party Links

We may link to external sites for convenience. fromzero.ai is not responsible for their content, availability, or security. Users access third-party links at their own risk.

11. Termination

We may suspend or permanently revoke your access to the Platform, without refund, for any violations of these Terms or harmful behavior.

We may also retire, archive, or rebrand the Platform at any time. In such cases, we will make reasonable efforts to preserve purchased tile placements in a legacy or successor version of the project.

12. Indemnification

You agree to indemnify and hold harmless fromzero.ai, its operators, and affiliates from any claims, damages, or legal liabilities arising from:

  • Your use of the Platform
  • Your breach of these Terms
  • Any third-party claims related to your tile, content, or linked website

13. Governing Law and Jurisdiction

 These Terms are governed by applicable local laws. You agree that any disputes will be resolved in a competent jurisdiction determined by the operator. 

14. Severability

If any provision is found invalid or unenforceable, the rest of these Terms will remain in full effect.

15. Refund Policy

By purchasing or claiming a tile, you agree to the following:

Overview

All tile claims on fromzero.ai are considered digital, customized, and non-transferable purchases. As such, all sales are final and non-refundable by default.

Payment Processor

Payments are processed securely via Lemon Squeezy.

Situations Where Refunds May Be Considered:

  • Duplicate or accidental payments
  • Technical issues during payment or tile submission
  • Fraudulent use of your payment method (with proof)

Timeframe to Request a Refund:

  • Generally honors refund requests within 120 days of purchase.

How to Request a Refund:

Contact us at [email protected]. Include your receipt, order details, and reason for the request. We will assess the case and respond in good faith.

Additional Conditions:

  • Refunds are not guaranteed and may be denied for abuse, fraud, or late submissions.
  • Approved refunds will be issued to the original payment method.
  • This policy does not override any rights you may have under applicable consumer protection laws.

16. Affiliate Program Terms

16.1 Overview
 fromZero.ai operates an affiliate program (the “Affiliate Program”) for the promotion of the Favicon Gallery and related products. Participation in the Affiliate Program is voluntary and subject to these Terms, our general Terms of Use, and Lemon Squeezy’s terms and policies.

16.2 Platform & Eligibility
 (a) The Affiliate Program is managed via Lemon Squeezy’s Affiliate Hub.
 (b) To participate, you must:
     (i) create and maintain a valid Lemon Squeezy affiliate account;
     (ii) be eligible to receive payouts in one of Lemon Squeezy’s supported payout countries; and
     (iii) submit an application to the fromZero.ai program and be approved.
 (c) We reserve the right to approve, reject, or remove any affiliate at our sole discretion.

16.3 Affiliate Links & Tracking
 (a) Once approved, you will receive a unique affiliate link, typically in the format https://fromzero.ai/?aff=YOURID.
 (b) Tracking, referrals, and commissions are handled by Lemon Squeezy’s systems using cookies and tracking IDs.
 (c) Our current tracking window is 365 days, with last-click attribution. If a customer clicks multiple affiliates’ links before purchasing, the most recent valid click will be credited.
 (d) We are not responsible for tracking failures caused by, including but not limited to, ad blockers, browser settings, cookie deletion, user behavior, or technical issues outside our reasonable control.

16.4 Commissions & Payouts
 (a) The standard commission rate is 50% per qualifying sale of eligible fromZero.ai products. For the Favicon Gallery tiles, this currently corresponds to around US$50 per tile sold at full price, provided no discounts, refunds, or external charges apply. We do not apply any additional internal fees or extra “house commission” on top of this rate.

(b) Commissions are calculated on the product price actually paid by the customer for the eligible item (after any discounts or coupons we offer), excluding any taxes added on top (e.g., VAT) and before any fees, charges, or currency conversion retained by Lemon Squeezy, payment processors, or financial institutions. Such external fees may affect the final payout you receive, but are not set or controlled by us.

(c) Payouts are managed and processed by Lemon Squeezy in accordance with their schedules and policies.
 (d) The minimum payout threshold is US$10. If your unpaid earnings are below this amount, they will roll over until the threshold is met.
 (e) We may, at our discretion, offer custom commission rates to specific affiliates. Any such custom terms will override the default rate for that affiliate only.

16.5 Refunds, Chargebacks & Invalid Referrals
 (a) If a sale is refunded, canceled, or results in a chargeback, any previously credited commission for that sale may be reversed or deducted from your unpaid balance or future payouts.
 (b) We may reject or reverse referrals we determine, in our sole discretion, to be fraudulent, abusive, or in violation of these Terms.

16.6 Prohibited Conduct
 You agree that you will not:

  • Promote fromZero.ai using spam, unsolicited messages, or misleading claims.
  • Bid on our trademarks or domain names (e.g. “fromzero”, “fromzero.ai”) in search ads without prior written consent.
  • Misrepresent your relationship with fromZero.ai or imply you are an employee, partner, or official representative.
  • Use cookie stuffing, forced clicks, or any mechanism that sets cookies without genuine user intent.
  • Promote fromZero.ai on websites or channels that feature illegal, hateful, or otherwise inappropriate content as reasonably determined by us.

We may suspend or terminate your participation and withhold commissions if we reasonably believe you have engaged in prohibited conduct.

16.7 Use of Brand Assets
 (a) You may use our name, logos, and visuals solely to promote fromZero.ai in a fair and accurate manner.
 (b) You must not modify our brand assets in a misleading or harmful way.
 (c) All goodwill generated from your promotional activities inures to fromZero.ai.

16.8 Disclosure & Compliance
 (a) You are responsible for complying with all applicable laws, regulations, and guidelines, including advertising and disclosure rules (for example, clearly disclosing affiliate relationships where required).
 (b) You acknowledge that you act as an independent entity and not as our employee, agent, or partner.

16.9 Program Changes & Termination
 (a) We may modify, suspend, or terminate the Affiliate Program, including commission rates, eligible products, and tracking rules, at any time with or without prior notice.
 (b) We may terminate your participation at any time, with or without cause. Upon termination, you must stop using affiliate links and our brand assets, and only valid, approved referrals generated before the termination date may be eligible for commission.

16.10 No Guarantees
 We do not guarantee any level of income or performance. Your results will depend on your own traffic, audience, and promotional efforts.

17. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page. Your continued use of the Platform indicates acceptance.
